Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Hotshot ("Hotshot", "we", "us", "our") and govern your access to and use of hotshot.cam, the Hotshot iOS app, and any related services (together, the "Service"). By using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.

1. Eligibility
You must be at least 13 years old (or the digital-services age of consent where you live — 16 in much of the EU) to use the Service. By using Hotshot you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you use Hotshot on behalf of an entity, you represent that you have authority to bind that entity.
2. Accounts and identifiers
Hotshot does not require you to create a separate account. We identify your install through a random anonymous ID stored in your iOS Keychain and, where applicable, your Apple Transaction ID for purchase entitlements. Keep your device secure — anyone with access to your unlocked device can use your Hotshot install and any associated subscriptions or credits.
3. Subscriptions, credits, and limits
3.1 Free use
Without a subscription, Hotshot grants you up to 3 AI shots per rolling 24-hour window. The limit refills automatically. We may change the limit at any time; the current limit is the one enforced by the Service at the moment of each shot.
3.2 Subscription plans
In short: two auto-renewing plans (weekly, yearly). Current price is the one Apple shows you in the App Store. Cancel anytime in your Apple ID settings.
Hotshot offers auto-renewing subscription plans. Current pricing for each plan is shown in the App Store at the moment of purchase. The current shot allowances are:
- Hotshot Pro Weekly — includes up to 30 AI shots per rolling 7-day week.
- Hotshot Pro Yearly — includes up to 50 AI shots per rolling 7-day week, subject to an overall ceiling of 400 AI shots per rolling 12-month year. When either cap is reached, additional shots can be funded with Credits (see 3.3) or by waiting for the cap window to roll.
Auto-renewal disclosure (Apple-mandated):
- Payment is charged to your Apple ID on confirmation of purchase.
- Subscriptions automatically renew at the end of each period at the price shown in the App Store unless you cancel at least 24 hours before the current period ends.
- You can manage and cancel subscriptions in your Apple ID account settings (Settings → [your name] → Subscriptions). Uninstalling the app does not cancel a subscription.
- Any unused portion of a free trial (if offered) is forfeit if you purchase a subscription before the trial ends.
- Subscriptions are not eligible for Apple Family Sharing.
3.3 Credits (consumable credits)
"Credits" are non-subscription credits sold in packs (currently 10, 30, and 100 Credits). Each AI shot beyond your free or subscription allowance consumes one Credit. Credits never expire and are tied to your in-app anonymous user ID; they are non-transferable, non-refundable (except where required by law or by Apple's standard refund policy), and have no cash value outside Hotshot.
3.4 Refunds
Apple processes all payments and handles refund requests. You can request a refund from Apple at reportaproblem.apple.com. We do not have the ability to issue or override Apple's refund decisions. Statutory rights that you cannot waive under your local law are not affected.
When you submit a refund request through Apple, Apple may request and we may share limited consumption data (such as how recently you installed, how many credits or quota shots you have used, whether the processed shot was delivered, and our preferred resolution) to help Apple evaluate your request. 3.5 Restoring purchases
You can restore prior purchases on a new device or after a reinstall via Settings → Restore Purchases in the app, provided you sign in to the same Apple ID used at the time of purchase.
3.6 Changes to pricing and limits
We may change prices for future subscription periods, the contents of Credit packs, or the shot limits described above. Material changes affecting existing subscribers will be notified in-app or by Apple at least 30 days in advance, with an opportunity to cancel before the new terms take effect. Free-tier limits may be adjusted at any time without individual notice.
4. Your photos and the license you grant us
In short: you own your photos. We get a narrow, time-limited licence only to process them and give the result back. No AI training.
You retain all rights to photos you upload, capture, or otherwise provide to the Service ("Your Content"). By using the Service, you grant Hotshot a worldwide, royalty-free, non-exclusive license to host, copy, transmit, process, and display Your Content solely for the purpose of generating the AI-processed result you requested and delivering it back to you, plus any operationally necessary technical processing (caching, transcoding, anti-abuse).
This license ends automatically when we delete the source photo, which we do as soon as processing completes (see our Privacy Policy for retention details). We do not, and will not, use Your Content to train AI models. Our AI processing provider is contractually prohibited from using Your Content to train its models.
5. Acceptable use
In short: no CSAM, no non-consensual deepfakes, no IP theft, no bypassing limits, no building a competitor with our output.
You agree not to use the Service to upload, generate, or distribute content that:
- Depicts a child in a sexualized, suggestive, or abusive way.
- Depicts non-consensual nudity, intimate imagery, or any "deepfake" of an identifiable real person without their explicit permission.
- Infringes copyright, trademark, right of publicity, or other intellectual-property or personality rights of any third party.
- Is unlawful, fraudulent, defamatory, harassing, threatening, hateful, or violates the rights of others.
- Contains malware or attempts to exploit vulnerabilities in the Service.
You also agree not to:
- Bypass or attempt to bypass rate limits, abuse prevention, or any technical control we put in place.
- Reverse-engineer, decompile, disassemble, or extract source code from the app or server, except to the limited extent expressly permitted by applicable law that you cannot waive.
- Use the Service to build, train, or evaluate a competing AI photo product.
- Resell, sublicense, or otherwise commercially exploit access to the Service without our written permission.
We may suspend or terminate access to the Service, in whole or in part, at any time and at our sole discretion — including without prior notice for violations of these Terms or to protect the Service, its users, or third parties.
6. AI-generated output
Hotshot uses third-party AI models to transform your photos. AI output may contain artifacts, distortions, biases, or unexpected elements; output for similar inputs is not reproducible. We do not guarantee that any output is accurate, lifelike, or suitable for any particular purpose. You are responsible for reviewing AI output before sharing, publishing, or relying on it, and for ensuring that your use of the output complies with applicable laws (including the rights of any people depicted).
To the extent any rights in AI-generated output exist and are ours to grant, we assign them to you (so you can use your processed photos however you like) — except where doing so would violate Section 5 (Acceptable Use).
6a. Reporting infringement (DMCA & equivalents)
If you believe content available through the Service infringes your copyright, send a notice to hello@hotshot.cam containing: (a) your physical or electronic signature; (b) identification of the work claimed to be infringed; (c) identification of the material claimed to be infringing and information sufficient to locate it; (d) your contact information; (e) a statement that you have a good-faith belief that use is not authorized; (f) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act. We respond to valid notices in accordance with applicable law and may remove allegedly infringing content and terminate repeat infringers' access.
7. Our intellectual property and your submissions
The Hotshot name, logo, app, website, dashboards, documentation, model prompts, and underlying technology are owned by us or our licensors and are protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, branding, or proprietary materials, except as strictly necessary to use the Service for its intended purpose.
Submissions. By sending us any question, comment, suggestion, idea, feedback, bug report, or other information about the Service ("Submissions"), you irrevocably assign to us all intellectual property rights in such Submissions and agree that we may use, modify, exploit, and distribute them without restriction, for any lawful purpose (commercial or otherwise), without acknowledgement or compensation to you. Submissions are not confidential. This clause does not apply to Your Content (photos), which is governed by Section 4.
8. Third-party services
The Service relies on third-party providers for hosting, payment processing, AI processing, abuse prevention, subscription management, and analytics. Their terms and outages are outside our control. We are not responsible for third-party services and do not endorse them. Categories of recipients of personal data are described in our Privacy Policy.
9. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, secure, timely, or error-free. To the maximum extent permitted by applicable law, we disclaim all warranties not expressly granted in these Terms.
10. Limitation of liability
In short: if something goes wrong, our total liability to you is capped at the greater of what you paid us in the last year or €50.
To the maximum extent permitted by applicable law:
- Neither party will be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost data, loss of goodwill, or business interruption — arising out of or related to these Terms or the Service, even if advised of the possibility.
- Our total cumulative liability arising out of or related to these Terms or the Service will not exceed the greater of (a) the amounts you paid us in the twelve months immediately preceding the event giving rise to the claim or (b) EUR 50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law (such as for death, personal injury caused by negligence, or fraud).
11. Indemnification
You agree to defend, indemnify, and hold harmless Hotshot and its officers, employees, and agents from any claim, loss, or expense (including reasonable legal fees) arising out of (a) Your Content, (b) your violation of these Terms or any law, or (c) your infringement of any third party's rights through your use of the Service. We may take over the defense of any claim at our discretion.
12. Termination
These Terms remain in effect for as long as you use the Service. We may suspend or terminate your access at any time, with or without cause, as described in Section 5. You may stop using the Service at any time. On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including your license grants for content already processed, our intellectual-property rights, the disclaimers, limitation of liability, indemnification, and governing law) survive.
13. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. For material changes, we will notify you in-app or by email at least 14 days before they take effect, where the law requires it. Your continued use of the Service after the effective date constitutes acceptance.
14. Governing law and disputes
In short: Portuguese law governs. EU consumers keep their home-country protections.
These Terms are governed by the laws of Portugal, without regard to conflict-of-laws principles.
If you are a consumer in the EU, UK, or EEA, you keep the protection of mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of that country.
For all other users, any dispute arising out of or relating to these Terms or the Service will be resolved exclusively by the competent courts of Lisbon, Portugal.
EU residents may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Apple-specific terms. If you obtained the app from Apple's App Store, these additional terms apply between you and us, not between you and Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support. In the event of any non-conformity to applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the app. We, not Apple, are responsible for addressing any claims relating to the app or your use of it, including product liability, regulatory compliance, and consumer-protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service.
- Severability. If any provision is held unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce any provision is not a waiver.
- Assignment. You may not assign these Terms without our consent. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for failure or delay due to events outside its reasonable control (natural disasters, internet outages, third-party service failures, government action, etc.).
